THE FACTS / THE INQUIRY:

The insured declared a major loss to his business caused by water pipe failure due to freezing.

Our investigation and our analysis of the objective and subjective elements demonstrated:

  • several improbabilities, false information during subscription and false statements after the loss,
  • pre-existing damage,
  • major shortcomings in the upkeep of the premises,
  • a catastrophic financial situation,
  • significant upcoming expenses,
  • that the representatives of the insured orchestrated a staging that led to the water damage.
THE RESULTS:

The insurer invoked the inadmissibility of the loss and requested the cancellation ab initio of the insurance policy.

The insured sued but signed a withdrawal following the presentation of the defense, in exchange for a final payment of $10,000, essentially a refund of the insurance premium.
